Minimum Orders

There is no minimum order value at Shark Island Institute.

We do everything we can to ensure the safety and security of your transaction at Shark Island Institute. This extends to our use of PayPal’s PayFlow services and online gateways, and our compliance with the full gambit of Australia’s privacy legislation.

Despite the care we take to ensure your safety and security, Shark Island Institute cannot be liable for any circumstance that may arise through the use of the internet or this website. You enter and use this site at your own risk, and without tortuous or contractual remedies, which are expressly excluded. See the section on limitation of liability in these terms and conditions.

Your continued use of the Shark Island Institute site constitutes an affirmation, acknowledgement and agreement by you that you accept and agree to abide and be bound by these terms and conditions and any modifications.

DELIVERY

Most goods are shipped within 1 to 2 business days from receipt of your order.

Credit Card Security

Shark Island Institute takes credit card security very seriously. Using your credit card to buy from Shark Island Institute is safe and secure. Shark Island Institute uses PayPal’s PayFlow online payment gateway to provide secure authorisation of credit card transactions over the Internet.

Your credit card details are not stored at Shark Island Institute or anywhere else on the Internet.

What if my card has been declined?

If your card is declined, please contact your card issuer for more information.

PayPal

Simply choose the PayPal option when you check out. After check-out, you will see a button that will link you direct to PayPal where you can complete your payment. Delivery will be processed as soon as your PayPal payment has been received. You do NOT have to notify us when you pay via PayPal as we are notified by PayPal automatically.

WHAT IF DVDS ORDERED ARE OUT OF STOCK?

If the DVD you want to order is out of stock, it will not be added to your cart and you will see a message saying the DVD is out of stock.

CANCELLED ORDERS

If you wish to cancel an order before it is delivered, you will have to pay a fee of 1.75% of the total value of the order if you paid using MasterCard or Visa, or 3.25% of the total value of the order if you paid using American Express. This fee is simply the fee your credit card company and bank charges us and is solely so that we are not out of pocket on the transaction. As an anti money-laundering measure, your refund will be processed in 7 working days.

SHIPPING

For deliveries in Australia we use Australia Post Surface Mail satchel, for international deliveries we use Australia Post Air Mail. Please refer to the tables below for Australian and International shipping charges in Australian dollars.

Returns Policy

If after placing your order you are not completely happy with your purchase, Shark Island Institute will refund the purchase price of, or replace purchased goods within 7 days of purchase for orders delivered within Australia, or within 14 days of purchase for international delivery orders, so long as all of the following conditions are met:

(a) All returns or credit requests require (i) a Return Authorisation (RA) number; and (ii) a copy of the original tax invoice.

(b) The goods must be returned to Shark Island Institute UNOPENED. Replacement goods or credits will not be issued until original goods have been returned to Shark Island Institute in their original condition. Once the delivery packet has been opened the delivery is taken to be accepted and title in the goods passes to you. We will not accept a subsequent return of your goods.

If a refund is requested then, subject to our returns policy, we will refund your credit card via the Verisign Secure Payments system. To do this, we do not access your credit card number, but simply recover the original transaction in the Verisign Secure Payments system and request a refund. As an anti money-laundering measure, credit requests will be processed within 7 working days. The refund will appear on your credit card statement.

OBTAINING A RETURN AUTHORISATION (RA) NUMBER

To obtain a Return Authorisation (RA) number send an email to admin[at]sharkislnd.com.au quoting the following information.

  1. Invoice number
  2. Purchase date
  3. Title
  4. Reason for return/credit

A Return Authorisation (RA) number will be issued and sent via return email, with instructions for the return of goods.

FAULTY / DAMAGED GOODS

Should any Shark Island Institute product be delivered faulty or damaged and you require a replacement or credit, you may do so by obtaining a Return Authorisation (RA) number via email to admin[at]sharkislnd.com.au.

An RA number will be issued and Shark Island Institute will send you a pre-paid envelope to return the faulty/damaged goods. Replacement goods will be despatched upon receipt of the faulty items by Shark Island Institute.

NOT WHAT YOU ORDERED / ORDER INCOMPLETE

You have 7 days from the date of purchase to alert Shark Island Institute that the goods you received are not what you ordered or that a delivery is incomplete by sending an email to admin[at]sharkislnd.com.au quoting the following information.

  1. Invoice number
  2. Purchase date
  3. Title ordered
  4. Title received

Our quality control systems are designed to ensure that faulty or damaged goods are not despatched to customers. Shark Island Institute will conduct an internal investigation into any claims of damaged goods. If we consider in our discretion, that the goods have or might have been damaged prior to despatch, then they will be replaced. Missing items will be shipped as soon as they are available.

Shark Island Institute will cover the cost of shipping the goods back to us if the goods are not what you ordered. We will do this by sending you a pre-paid envelope. All you have to do is place the goods in the envelope and put it in the post. Replacement goods will be despatched upon receipt of the returned items by Shark Island Institute.

DISCONTINUED PRODUCTS

Shark Island Institute will discontinue some products from time to time.

DVD FORMATTING

Australian DVDs are formatted in PAL unless stated otherwise on our website. Please refer to each individual item’s page for any special requirements. Before purchasing DVDs from Shark Island Institute please ensure your television and DVD player are PAL compatible. Discs produced by Shark Island Institute do not contain region encoding and provided your player is PAL compatible should play in all regions of the world.

Note that DVDs are classified in accordance with the content rating system in force in Australia only. The purchaser is responsible for any censorship, content or import restrictions in the country of delivery.

Limitation of Liability

All conditions and warranties contained in or implied by statute or rule of law into these terms and conditions are expressly excluded and negated, provided that nothing in these terms and conditions may exclude, restrict or modify any condition, warranty, right or liability which may at any time be implied into these terms and conditions (including any condition, warranty, right or liability implied by the Trade Practices Act 1974 or any similar applicable State or Territory legislation) where to do so is illegal and would render any provision of these terms and conditions void.

To the extent permitted by law, Shark Island Institute expressly limits its liability for breach of a condition or warranty set out in or implied into these terms and conditions by virtue of any legislation to, at the choice of Shark Island Institute:

(a) the supply of the goods breaching such condition or warranty again; or
(b) the payment of the cost of having such goods supplied again.

Except as otherwise expressly stated in this Deed, in no event will Shark Island Institute be liable for any loss or damage that you suffer arising from, or caused or contributed to by Shark Island Institute’ negligence or the negligence of its officers, employees or for any special, indirect or consequential loss or damage as a result of a breach by Shark Island Institute of these terms and conditions and Shark Island Institute accepts no other responsibility or liability whatsoever except for damages that are sustained by you as a direct result of Shark Island Institute’ fraud or wilful misconduct.

PRIVACY

Shark Island Institute complies with the National Privacy Principles and the Privacy Act 1988. All information collected at this site will be kept strictly confidential and will not be sold, rented, loaned, or otherwise disclosed to any person or company except for the express purpose of fulfilling Shark Island Institute’ obligations to deliver you the product you have ordered. Any information which you allow Shark Island Institute to collect will be held by us with all due care, and will not be used by us or by any third party in ways to which you have not agreed. You are entitled to request us to provide to you the details of any information held about you and to correct any errors in that information.

What information is collected

You may visit and browse Shark Island Institute anonymously. Shark Island Institute will only collect personal information such as your e-mail address when you wish to place an order with us or contact us through the encrypted email form.

Various statistical information including your computer’s IP (Internet Protocol) address, your browser type and which pages you visit may be recorded for statistical use only. This information is anonymous and is not linked to any of your personal information in any way.

We will ask you to supply personal information, such as your name, e-mail address and postal address, when you make a purchase or contact us.

We will use your e-mail address to create a personal identification. Your e-mail ID gives you fast and easy access to the Shark Island Institute Shop.

Using your e-mail address and a password, you fill out your order including delivery address and contact details. You may use these to order from Shark Island Institute a second or subsequent time. Simply enter your Shark Island Institute ID and password, and our computers look up the information to help you fill out the order form.

Personal information will be held for a period of seven years unless a request is made by the relevant individual to have that personal information permanently deleted from our records.

Shark Island Institute is the owner or exclusive licensee throughout the world of the copyrights in all goods sold on this website or by Shark Island Institute (the DVDs, books and study guides). The DVDs are protected by the laws of Australia and by extraterritorial operation of that law and international treaties, all other jurisdictions.

Copying of any of the DVDs or any part of the DVDs, their packaging, trade dress or content is strictly forbidden. The DVDs are provided to you under limited license to enjoy for your personal use only.

Any copying, decompiling, publication, storage in a retrieval system, alteration or transmission in any form or by any means in whole or part (except where such use constitutes fair dealing under the Copyright Act) without the prior written approval of Shark Island Institute constitutes an infringement and will be prosecuted to the full extent of the law.
